It’s often overlooked. When people work with us it’s one of the things that I ask about in our initial consultation is how the accident affected somebody psychologically. Most of the time people don’t even though they can seek treatment for emotional damage and that they are entitled to compensation for those injuries as well as the physical injuries.

Sometimes my clients look at me like what. And I say I know you were injured, I know your neck hurts, I know you’ve got bruises from the seatbelt and from the airbag, but how are you sleeping? And how has it felt when you get back in the car? Then they answer, “You know, well, I haven’t driven yet, but I was a passenger the other day.” And how was that? “It was horrible. You know, every time we started to come to slow down at a traffic light or a stop sign, I’m looking in the rear-view mirror and I’m hitting the floor with my feet, trying to stop the car for the driver”, they respond. And so, in those cases we send people out for counseling and sometimes they’re diagnosed with PTSD. 

If the accident was serious, maybe they suffer from an anxiety that they need a little talking and a little walking through and understand how they can sort of move past it.
