It Could Have Been A Kidnapping Charge

There was a young man who with his girlfriend had been off and on through high school. They were the high school prom king and queen. He was the quarterback on the football team. She was a varsity volleyball player. He had ultimately got a scholarship to a major university and played quarterback up there. When he was home for his first visit back from college after his freshman year, he learned some things about his girlfriend that she had been at Coachella and she had been making out with some other guy.

And so he went to confront her. She gets in the car and they start having an argument. Now this wasn’t the first time they had a verbal argument. And to make matters worse, the girl’s family hated my client. They didn’t think they were right for each other. They were like gasoline with a match, very volatile. But nothing had ever resulted in a criminal violation or anything like that. And he had never been accused of hitting her. But it was your basic high school-ish jealously type stuff. Now on this particular day the girl gets in the car and he asks to see her phone and she doesn’t want to give it to him, but ultimately does. And he starts looking in the phone and seeing pictures with her with other guys.

And so they’re arguing. The girl’s older brother who hates my client, and who had actually gotten into a fist fight with him three years earlier when they were in high school, comes running out of the house with his mother and my client sees him coming and takes off in his car. Mom and the brother get in their car and start chasing him through the city in their car. Meanwhile, the brother who’s in the passenger seat with the mom is calling 9-1-1. Within minutes, there’s a helicopter in the air. There’s 10 police cars involved and they ultimately head off my client and pull him out of the car and they arrest him for kidnapping. We’ve been fighting kidnapping charges since 2019. And, finally, after 3 years we resolved it for a misdemeanor reckless driving charge.

If my client didn’t have representation he could have been facing upwards of 12 years in prison. Under a misdemeanor charge he doesn’t risk a State prison or a felony conviction.
