7 Questions to Ask a Prospective Personal Injury Attorney

How much experience do you have handling cases like mine? Not only do you want a lawyer who has years or decades of experience on your side, you also want to ensure he/she has handled many similar cases like yours. You may also follow up by asking how many successful verdicts or settlements they have obtained.

Do I have a good case? After you disclose the details of your case, any prospective attorney can determine if there is a good chance you can recover financial compensation and even the general range of your potential damages. Additionally, you should also ask what the weaknesses of your case are. 

  1. Are you willing to take my case to trial if you cannot reach a settlement? You also want a lawyer who is not afraid to pursue your entitled compensation in court if the insurer refuses to settle or offer a fair amount.  Insurance companies typically make low initial offers before taking all your damages into account. 

  1. Will you handle my case directly? You need to know who will handle various aspects of your case. It is not uncommon to first speak with a partner, but the case is then handled by an associate attorney and/or paralegal.   1. How much are your legal fees? Most attorneys in California work on a “contingency fee” basis, which means you won’t have to pay anything unless you win your case. If the lawyer is victorious, then the fee will be a percentage of your compensation, generally between 25 percent to 40 percent.
